We love our dogs and want only the very best for them.   If you ever have any problems with one of our dogs or are unable to keep your dog from us for any reason, please contact us FIRST.  This is our contract and health guarantee.

At Home Cocker Spaniels
Homing Agreement
 

                                                                               

This document serves as an agreement between the parties described above: At Home Cocker Spaniels hereafter referred to as “the Breeder.” and ____________________________________________hereafter referred to as “the Buyer.” The Buyer hereby agrees to purchase the dog described below, hereafter referred to as “the Dog” from the Breeder for the sum of $­___, and further agrees to all items in this contract.

Conditions:
 

1.    The Dog described above is a purebred American Cocker Spaniel and can be registered with the American Kennel Club.  The information provided about this dog’s identity is accurate to the best knowledge of the Breeder.

2.    The Dog has received the appropriate vaccinations and worming as noted in the Health Record provided to the Buyer at the time of sale.

3.    This Dog is guaranteed to be in good health at the time of sale. Breeder has taken every precaution to insure the physical soundness and mental stability of this puppy to date. Puppy is active, eating well, and has been checked by a licensed veterinarian.  

Terms:

4.    The Buyer agrees to have the Dog examined by a licensed veterinarian within fourteen (14) days of the date of purchase. If an illness or other health defect, excluding internal parasites, is found by the veterinarian within that time, the Buyer will provide a written diagnosis from the examining veterinarian to the Breeder. The Breeder may request a second diagnosis to confirm the first diagnosis. The Buyer then has the option of returning the dog for an exchange of a dog of equal or greater value when one becomes available or keeping the dog and treating the illness/defect.

5.    The Buyer agrees to provide a copy of the results of all eye, hip and elbow examinations to the Breeder.

6.    This contract extends limited AKC registration to the buyer.  The buyer is given permission to use the MarKel name when registering the dog. 

7.    The Buyer agrees to have the dog desexed at sexual maturation and never to breed the dog.

8.    The Buyer agrees to provide appropriate food, water, shelter and veterinary care throughout the lifetime of the dog.

9.    The Buyer agrees to train the Dog, recognizing that the Dog’s behavior is in large part a direct result of being adequately trained, disciplined and socialized.  This includes but is not limited to: house-training, leash-training, the ‘sit’, ‘come’ and ‘drop-it’ commands.    

10. The Buyer agrees that the Dog will not at any time be tethered, tied, or chained in a yard or other location. The Buyer further agrees that the Dog will not be kept exclusively outside in a yard or kennel. The Buyer also agrees to keep the dog in a securely fenced yard or other enclosure, and/or on leash while outside, and will not allow the dog to be outside unaccompanied in an unenclosed area at any time.

11. If at any time throughout the lifetime of the Dog, the Buyer becomes unable or   unwilling to keep the Dog, the Buyer agrees to inform the Breeder immediately. If the Buyer has another suitable home in mind for the Dog, the dog may be placed there.

 

Limitations:

12. Every precaution has been taken in the breeding of this Dog, however, due to changes that can and do occur as a dog matures there can be NO guarantees for the following:

·         Viral or bacterial infections and parasites

·         That this Dog can be shown or bred

·         The size and color of the adult

·         Cherry eyes

Guarantee:

13. If at any time before the puppy's 1st birthday, the puppy is found to have a life threatening congenital defect that prevents the puppy from leading a normal life or prohibits the pup from maintaining a normal pet/companion relationship, have your vet document this condition with a signed written statement. Upon return of the defective puppy, a replacement puppy of equal value will be given upon availability. The defective puppy must be in good clean condition as when it left the breeder. It must be current on all vaccinations, dewormings and have been maintained on a healthy diet. In the event of death, an autopsy, at the expense of the buyer, must be obtained to establish cause.

      
By signing below, the Buyer agrees that he/she has read and understands the foregoing and agrees that this contract constitutes a binding agreement. Both the Buyer and the Breeder agree to adhere to the terms of this contract. The Buyer also acknowledges receipt of a copy of this contract.
